Design4epage does not operate, control or endorse any information, products or services on the Internet that is not identified as being supplied by our site. Except for Design4epage identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties that are not affiliated with Design4epage.

In using this site, you agree with the conditions stated below:

  • Not to transmit any message, information, data, text, software or images, or other content ("Material") that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable that may invade another's right of privacy or publicity;
  • Not to impersonate any person or entity, including but not limited to, an Design4epage official, forum leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Not to post or transmit any Material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements);
  • Not to post or transmit any Material that contains a virus or corrupted data;

  • Not to install chat rooms without the approval of Design4epage team. However, we do provide a choice of Java chat rooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others.
  • Not to upload background running programs, unless with the permission of Design4epage team. These can be considered on a one-to-one basis, and extra charge will be incurred based on system resources used and operational maintenance needed.
  • Not to upload any IRC or IRC bots since this is not allowed for operation in our servers.

You accept total responsibility and risk for your use of the site and the Internet. Design4epage provides the site and related information "as is" and does not make any express or implied warranties, representations or endorsements with regard to the service, any merchandise information or service provided through the service or on the internet generally. Design4epage shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the service or on the Internet generally. You understand further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to you. You access such materials at your risk. Design4epage has no control over and accepts no responsibility whatsoever for such materials.

 PAYMENT INFORMATION

TERMS AND CONDITIONS:

  • For web design services the condition will be 50% down payment before we start the project, and another 50% is payable upon completion of project.
  • Payments can me made using All Major Credit Cards, Wire/Bank transfer, Paypal. Contact your Account Representative on the details of the payment methods.
  • Payments must be made promptly as indicated in the Invoice sent and must be in  $ funds. All accounts are payable within 7 days of invoice. If we do not receive your payment on-time, your account may be terminated. Design4epage reserves the right to remove any hosting services, web design and development project from viewing on the Internet, not to send the finished project to client, and necessary projects upload until final and full payment is made.
  • You will remain liable for all fees during any period when Services have been discontinued or suspended due to a failure on your part to comply with these terms and conditions.
  • You are liable to pay overdue interest at 5% /week on any amounts not paid within 7 days of invoice. All intellectual property rights remain with Design4epage.Com until payment.
  • You must pay Design4epage charges without any set off; counter claim or deduction unless same is agreed in writing between us
  • Design4epage reserves the right to prioritize early paying clients and to charge urgency fees for turnaround within 3 working days.
  • Agreed Costing is conditional on your supplying data required for a Website Stage or completion deadline agreed within 10 working days of confirmation of Order. Design4epage reserves the right to revise costing if that condition is not met in line with charges applying at the relevant time.
  • You must pay all charges as set out in the Web Hosting and Web Design Packages Section. As prices quoted on Design4epage material may change at any time without notice, please check the price on your Web Hosting and Web Design Packages Section before confirmation.

Failure to comply with the above payment terms is subject to immediate cancellation of the trial/service. 

TERMINATION OR CANCELLATION OF SERVICE
Design4epage reserves the right to suspend services in any case where you fail to perform your obligations under this agreement or your usage exceeds acceptable usage limitations as judged by Design4epage.

You can cancel your account at any time, properly informing Design4epage preferably a week before the next due date. Please include the following details in your notification: direct contact with your Customer Service Representative, written notification, or e-mailed notification addressed to .

Failure to pay does not constitute proper notification, and you will be responsible for all fees accrued to your account until proper notification is received.

Design4epage reserves the right to cancel this service and reimburse you with any unused fees (where appropriate) on a pro-rata basis.

If your service is cancelled for misuse according to these Terms and Conditions, Design4epage reserves the right to apply additional fees and/or administrative costs incurred to your account prior to reimbursement. Please allow 4-6 weeks for reimbursement payment.

 WEB PAGES CONTENTS AND UNDERTAKINGS
Design4epage is not responsible for the content, and functionality of the clientele web site. This is the sole responsibility of the client. Content proofreading is also not our responsibility, unless specifically agreed by both parties.

The goods, material, photographs, film, data or information which the customer provided us to be used in any form, hereby guarantees that it does not infringe the rights of third parties and indemnifies Design4epage against any action by any third party. With this agreement, the customer agrees not to infringe the copyright trademark, privacy or personal or proprietary rights of third parties, supply libelous, abusive, obscene material or disparage the products or services of any third party.

Design4epage for its part hereby undertakes not to knowingly infringe the rights of third parties in activities conducted on your behalf. Customer is solely responsible for any dealings done with other person/s that accessed their data or web page, and warrants that any complaints or inquiries in relation to that data will not be referred to Design4epage.

TECHNICAL SUPPORT, CHANGES AND MAINTENANCE
Design4epage offers technical assistance via telephone or e-mail. Site maintenance will be charged at hourly rates, while site updates will be billed in half-hourly increments. Please see particulars of hourly rates in Design4epage Fee Schedule

 WEB HOSTING
Design4epage can upload final exported sites to the customer’s preferred host company, if, and only if, the customer themselves choose to manage or arrange their own web hosting. We can install, upload and setup the application/ web pages that have been made based on a specific request. Additional charge per hourly basis will be applied. However, please take note that Design4epage accepts no responsibility for delays or down time, breakdowns or data loss caused by Internet Service Providers (ISPs).

INTELLECTUAL PROPERTY RIGHTS
All created files remain the property of Design4epage. Our company also retains the copyright in and any use of all artwork created in advancing the profile of Design4epage, and the recognition for artwork created by our team.

Design4epage shall be free to reproduce, use, disclose display exhibit, transmit, perform, create derivative works, and distribute any item from your Web Page unless specifically agreed otherwise. Further, Design4epage shall be free to use any ideas, concepts know-how or techniques acquired in construction of sites for any purpose whatsoever including but not limited to developing, manufacturing and marketing products and other items incorporating such information unless specifically agreed otherwise.

FILE BACKUPS RESPONSIBILITY OF CUSTOMER
It is the responsibility of the customer to maintain a backup copy of their files to ensure recovery in the event of loss or damage to their files. However, upon request, Design4epage may make periodic backups of the files, but we will not guarantee either expressed or implied as to the integrity of the said backup.

In cases, that the file is loss due to the negligence or error done on the part of Design4epage, we will attempt to recover the lost files from the most recent archives at no cost to the customer. On the other hand, if the file is loss due to the improper action of the customer or due to sabotage or damage brought on by customer’s negligence of making their account secured; Design4epage takes no responsibility to attempt recovering the files from the customer’s most recent archives. As our customer, please be informed that you should not completely rely on us all the time for the said backup, even though we normally create excellent backups of your data. There are improbable situations wherein we could not be able to reproduce a backup after multiple system failure. We cannot accommodate overall data to be stored on our servers. Kindly store a copy of critical data on your computer.

Under this terms and condition in lieu of any failure or deficiency of the Design4epage network, customer shall not receive any credits in cases such as:

  • Special circumstances beyond reasonable control, including and without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, "Acts of God" (i.e. fire, flood, earthquake, tornado, etc...), strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, failure of third party software or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the terms and condition and service level agreement.
  • Telco failure
  • Scheduled maintenance for hardware/software upgrades.
  • DNS issues not within the direct control of Design4epage.
  • Client’s acts or omissions, including without limitation, any negligence, willful misconduct, or use of Design4epage service(s) in breach of Design4epage.

DISCLAIMER
Design4epage is not responsible for any damage(s) the customer’s business may suffer. Our company makes no warranty of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose, including loss of data resulting from delays, non-deliveries, wrong delivery, and any service interruptions caused by our Web hosting service and our employees. Design4epage reserves the right to revise the policies herein at any time.

All end-users must adhere to the above policies. Failure to follow any terms or condition will be grounds for immediate account deactivation.
